When you have been arrested for DWI, a government agent has stopped you and intruded on your freedoms to go about your business. He or she has searched you multiple times and forced you to give evidence against yourself (field sobriety tests, PBT, and evidentiary blood / breath / or urine test).

If you’re swerving all over the road and you’re a danger, then the cop has “reasonable articulable suspicion” to pull you over. And if your eyes are bloodshot and you are slurring your speech, he or she should ask some questions and consider taking you off the road.
But too often, cops pull over citizens and subject them to intrusions on their liberty without due process or freedom from search and seizure.
